Last month, the Equal Employment Opportunity Commission convened a public meeting to discuss the impact of social media on employment relationships. Unlike the National Labor Relations Board, which for years has been litigating disputes over how far employees can go in criticizing their employers and workplaces online, the EEOC focuses on issues of discrimination and harassment in the workplace. For example, although nearly all employers use social media to screen candidates, this process can also expose the employer to protected information about the employee that it should not know, creating ammunition for claims of discrimination in hiring practices.
